Warranty Policy

Apex Performance Supply is a trading name of Watty’s Fabrication Pty Ltd (ABN 20 678 587 141).
Apex Performance Supply sells automotive performance parts, accessories and motorsport products from a range of manufacturers and suppliers. Warranty conditions and warranty periods can vary between products and manufacturers.
This Warranty Policy explains how warranty claims are handled for products purchased from apexps.au or directly from Apex Performance Supply.
Nothing in this Warranty Policy excludes or limits any rights you may have under the Australian Consumer Law.

WARRANTY COVERAGE

Where applicable, products sold by Apex Performance Supply may be covered by:
  • A manufacturer’s warranty;
  • A supplier or distributor warranty;
  • An express warranty supplied with the product; and/or
  • Consumer guarantees provided under Australian Consumer Law.
The applicable warranty period may vary depending on the product and manufacturer.
Proof of purchase will be required for warranty claims.
Apex Performance Supply may provide a repair, replacement, exchange, refund or other remedy where required under Australian Consumer Law or where approved under the applicable manufacturer or supplier warranty.
This may include circumstances where a product:
  1. Is faulty or not of acceptable quality;
  2. Is not reasonably fit for its intended purpose;
  3. Does not match its description; or
  4. Otherwise fails to meet an applicable consumer guarantee.

WARRANTY CLAIM PROCESS

Step 1 – Contact Us Before Returning the Product

Before returning a product, please contact Apex Performance Supply.

Where appropriate, we may ask you to first:
  • Review the product instructions;
  • Confirm the product has been installed and used correctly;
  • Follow any troubleshooting procedures supplied with the product;
  • Check manufacturer technical information;
  • Provide photographs or video showing the issue; and
  • Provide information about the vehicle, application or installation.
Many issues can be identified or resolved without the product needing to be returned.
Do not return a warranty item without first receiving approval from Apex Performance Supply.

INFORMATION REQUIRED FOR A WARRANTY CLAIM

When contacting us, please provide:
  • Your name;
  • Order or invoice number;
  • Proof of purchase;
  • Product name and part number;
  • Date of purchase;
  • Description of the fault;
  • When the fault first occurred;
  • Vehicle or application details where relevant;
  • Details of how the product was installed;
  • Photographs or video where requested; and
  • Any troubleshooting already completed.
We may request additional information where reasonably required to assess the claim.

Step 2 – RETURN FOR ASSESSMENT

If the issue cannot be resolved remotely, we may ask you to return the product for inspection or testing.
We will provide return instructions once the warranty return has been approved.
Please do not send products directly to a manufacturer, supplier or distributor unless specifically instructed by Apex Performance Supply.
Returned warranty products should include:
  • The product being claimed;
  • Proof of purchase;
  • Your return or warranty authorisation details; and
  • Any components or accessories reasonably required to test the product.
Please package the item securely to prevent damage during transport.

WARRANTY ASSESSMENT

Receipt of a product for assessment does not automatically mean that the warranty claim has been approved.
The product may need to be:
  • Inspected by Apex Performance Supply;
  • Tested by our supplier;
  • Returned to the distributor;
  • Returned to the manufacturer; or
  • Assessed by an authorised repairer.
We may rely on reasonable technical assessment from the manufacturer or supplier when determining the cause of a product failure.
Assessment times can vary depending on the product and whether it needs to be returned to an interstate or overseas supplier or manufacturer.
We will keep you informed where there is a significant delay.

APPROVED WARRANTY CLAIMS

Where a product is confirmed to be faulty and the claim is covered by Australian Consumer Law or the applicable product warranty, an appropriate remedy may include:
  • Repair;
  • Replacement;
  • Exchange;
  • Refund; or
  • Another remedy agreed with you.
The appropriate remedy will depend on the nature of the fault, the applicable warranty terms and your rights under Australian Consumer Law.

RETURN FREIGHT

Please contact Apex Performance Supply before arranging freight for a warranty claim.
If a product is found to have a genuine fault covered by Australian Consumer Law, you may be entitled to reimbursement of reasonable return freight expenses where applicable.
Please retain receipts or other evidence of freight costs if you intend to request reimbursement.
Where a returned product is assessed and no product fault is found, or the problem is found to result from something not covered by warranty, you may be responsible for:
  • Return freight;
  • Re-delivery freight;
  • Testing or assessment costs where reasonably disclosed beforehand; and
  • Other reasonable costs associated with returning the product to you.
We will advise you before charging any significant assessment or return costs.

MANUFACTURER & SUPPLIER WARRANTIES

Because Apex Performance Supply sells products from numerous brands, warranty terms may differ between manufacturers.
A manufacturer may specify particular:
  • Warranty periods;
  • Installation requirements;
  • Service requirements;
  • Approved applications;
  • Operating limits;
  • Maintenance requirements; or
  • Claim procedures.
Where a manufacturer’s warranty applies, the product may need to be assessed in accordance with those warranty terms.
Manufacturer warranty conditions are in addition to and do not replace any rights you have under Australian Consumer Law.

INSTALLATION REQUIREMENTS

Automotive performance products must be installed correctly and used for their intended purpose.
Where appropriate, we recommend installation by a suitably qualified or experienced person.
Before installation, the customer or installer should confirm:
  • The product is correct for the application;
  • The product has not been damaged in transit;
  • The specifications are appropriate;
  • All installation instructions have been followed;
  • Correct fittings, fluids and fasteners are being used;
  • Correct torque specifications are followed; and
  • The finished installation is safe.
If you believe a product is incorrect or damaged, do not install it. Contact Apex Performance Supply first.

ITEMS THAT MAY NOT BE COVERED BY WARRANTY

Subject to your rights under Australian Consumer Law, warranty coverage may not apply where the fault or damage has resulted from:
  • Incorrect installation;
  • Incorrect application;
  • Misuse or abuse;
  • Neglect;
  • Modification or alteration;
  • Accidental or impact damage;
  • Failure to follow manufacturer instructions;
  • Incorrect wiring;
  • Incorrect polarity;
  • Over-voltage or electrical faults;
  • Excessive heat;
  • Water ingress where the product is not designed for water exposure;
  • Corrosion caused by external conditions;
  • Incorrect fuel, oil, coolant or other fluids;
  • Chemical incompatibility;
  • Operation outside specified pressure, temperature, RPM or load limits;
  • Insufficient maintenance;
  • Normal wear and tear; or
  • Continued use after a fault became apparent.
A warranty will not automatically be refused merely because a product has been installed. The cause of the failure and the applicable warranty conditions will be considered.

MOTORSPORT & COMPETITION USE

Apex Performance Supply sells many products specifically intended for motorsport and competition use.
Accordingly, motorsport use does not automatically void the warranty on every product we sell.
However, some manufacturers exclude or limit warranty coverage where a product is:
  • Used in racing or competition;
  • Used in professional motorsport;
  • Used outside its intended design specification;
  • Subjected to loads or conditions beyond the manufacturer’s specifications; or
  • Used in an application specifically excluded by the manufacturer’s warranty.
Where a product is expressly designed and sold for motorsport use, the manufacturer’s warranty terms applicable to that motorsport product will apply.
Competition and racing products can operate under extreme conditions, and normal wear, consumable components and damage caused by accident or racing incidents are not generally considered manufacturing defects.

MODIFIED PRODUCTS

Products that have been modified, drilled, cut, welded, machined, rewired or otherwise altered may not be eligible for warranty where that modification caused or contributed to the failure.
Please contact us before modifying a product if you believe it may already be faulty.

CONSEQUENTIAL COSTS

A warranty claim relating to a product does not automatically mean that associated costs are covered.
This may include costs such as:
  • Removal and installation labour;
  • Vehicle recovery;
  • Towing;
  • Accommodation;
  • Travel;
  • Lost income;
  • Vehicle downtime;
  • Missed racing events;
  • Entry fees; or
  • Other associated expenses.
Any entitlement to compensation for reasonably foreseeable loss or damage will be determined in accordance with the Australian Consumer Law and the circumstances of the claim.

PROOF OF PURCHASE

Proof of purchase is required for warranty claims.
Acceptable proof may include:
  • Apex Performance Supply tax invoice;
  • Website order confirmation;
  • Receipt;
  • Account transaction record; or
  • Other reasonable evidence showing the product was purchased from Apex Performance Supply.

PRODUCTS PURCHASED ELSEWHERE

Apex Performance Supply can generally only process warranty claims for products purchased directly from us.
If you purchased the product from another retailer, you should contact the business from which it was purchased.

AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You may be entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage.
You may also be entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Manufacturer warranty periods and conditions do not remove these statutory rights.
Nothing in this Warranty Policy is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot legally be excluded.
