The website at apexps.au (the “Website”) is operated by Watty’s Fabrication Pty Ltd trading as Apex Performance Supply.
In these Terms and Conditions, “Apex Performance Supply”, “we”, “our” and “us” means Watty’s Fabrication Pty Ltd trading as Apex Performance Supply, and “you” and “your” means the customer, purchaser or user of the Website.

PRICING ERRORS

ORDER CANCELLATION

We cannot guarantee cancellation once an order has entered processing, been packed, been ordered from a supplier or been dispatched.
Special-order, supplier-procured and dropship items may not be cancellable once the supplier has accepted or processed the order.
Where a cancellation is treated as a change-of-mind return, our Returns Policy may apply.
PAYMENT
Customers must pay the full amount shown at checkout unless alternative payment terms have been expressly agreed with Apex Performance Supply.
Available payment methods will be displayed during checkout.
Payment must be successfully authorised before an order is dispatched unless an approved account arrangement applies.
Apex Performance Supply does not generally store complete payment card information where payments are processed through a third-party payment provider.

SHIPPING & DELIVERY

Depending on stock availability, products may be dispatched:

- From one of our supplier or distributor warehouses; or
- From multiple locations.
An order containing several products may therefore arrive in separate deliveries.
Dispatch and delivery times are estimates and may be affected by circumstances outside our reasonable control.

DELIVERY ADDRESS
You are responsible for supplying a complete and accurate delivery address when placing your order.
Additional costs arising from an incorrect or incomplete address, failed delivery or customer-requested redirection may be charged to the customer where permitted.
We may be unable to alter a delivery address once an order has been dispatched.
INTERNATIONAL ORDERS
Where Apex Performance Supply agrees to supply products internationally, additional freight costs, taxes, duties, customs fees or import charges may apply.
Unless expressly stated otherwise, these charges are the responsibility of the customer.
The customer is also responsible for confirming that the products may lawfully be imported into and used within the destination country.
Some products may not be available for international delivery due to manufacturer restrictions, hazardous-goods requirements or freight limitations.
SHIPPING RESTRICTIONS
Certain products may be subject to transport restrictions because of their size, weight, contents or classification.

Where special freight requirements apply, we may contact you before dispatch to discuss available delivery options and any additional costs.
RETURNS & REFUNDS
Returns, exchanges and refunds are governed by our separate Returns Policy.
Change-of-mind returns may be subject to conditions including:

- Prior return approval;
- Product remaining unused and in resaleable condition;
- Original packaging being retained;
- Customer-paid return freight; and
- A restocking fee of up to 15%, where applicable.

INSTALLATION OF AUTOMOTIVE PRODUCTS
Many products sold by Apex Performance Supply are intended for automotive, motorsport or performance applications and may require specialist installation.
Products should be installed by a suitably qualified or experienced person where appropriate.
The customer and installer are responsible for:
- Checking the product before installation;
- Confirming compatibility;
- Following manufacturer instructions;
- Using appropriate tools and procedures;
- Ensuring correct torque settings and specifications;
- Checking all connections and fasteners;
- Ensuring the completed installation is safe; and
- Ensuring the vehicle complies with applicable road, racing and safety regulations.
Do not install a product that appears damaged, incorrect or unsuitable.
MOTORSPORT & COMPETITION PRODUCTS
Some products sold by Apex Performance Supply are designed specifically for racing, competition or off-road applications.
It is the customer’s responsibility to determine whether a product:
- Is permitted under the relevant racing regulations;
- Meets the required certification or technical standard;
- Is legal for road use; and
- Is appropriate for the intended application.
Rules and regulations vary between sanctioning bodies, racing categories and jurisdictions and may change over time.
The sale of a product does not represent a guarantee that it complies with a particular competition rule or road-use requirement unless expressly stated.
VEHICLE MODIFICATION & ROAD LEGALITY
Some performance products may affect a vehicle’s emissions, noise, safety systems or roadworthiness.
Customers are responsible for ensuring modifications comply with applicable:
- State and territory laws;
- Vehicle standards;
- Registration requirements;
- Emissions requirements; and
- Engineering certification requirements.
A product being available for purchase does not automatically mean that it is approved for road use in every jurisdiction.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Apex Performance Supply will not be responsible for indirect or consequential loss arising from circumstances outside our reasonable control.
This may include loss resulting from:
- Delivery delays;
- Vehicle downtime;
- Missed events or competitions;
- Labour charges;
- Incorrect customer selection;
- Incorrect installation; or
- Use of a product outside its intended application.
However, nothing in these Terms and Conditions excludes, restricts or modifies liability where doing so would breach the Australian Consumer Law or another applicable law.
AUSTRALIAN CONSUMER LAW
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You may be entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage.
You may also be entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

These Terms and Conditions are governed by the laws of Western Australia and Australia, as applicable.
